OVERVIEW

Welcome to OffOnArt! The terms “we”, “us” and “our” refer to OffOnArt. OffOnArt operates this online marketplace, including all related information, content, features, tools, products, and services (the “Services”). OffOnArt is powered by Shopify, which enables us to provide these Services to you.

OffOnArt is a digital products marketplace where third-party sellers can upload and sell AI-generated digital products. These products are generated using artificial intelligence tools and uploaded directly by independent third-party contributors (“Sellers”).

We do not create, own, or control the content of these products. All intellectual property rights remain with their respective owners. If you believe any product on our marketplace infringes your intellectual property rights, you should contact us as described in Section 6 – Intellectual Property & IP Complaints.

By visiting, interacting with, or purchasing from our marketplace, you agree to be bound by these Terms and our Privacy Policy [LINK]. If you do not agree, you should not use our Services.

SECTION 1 – DIGITAL PRODUCTS

All products sold on OffOnArt are digital goods delivered electronically. Once the product is made available to you, all sales are final. We do not accept returns, exchanges, or refunds except in cases of defective or incorrect files as described in our Refund Policy [LINK].

SECTION 2 – ROLE AS A MARKETPLACE

OffOnArt acts as a marketplace platform that allows third-party Sellers to list and sell AI-generated digital products.

  • We do not pre-screen or manually review every product before it is listed.

  • We do not claim ownership of any intellectual property in the products listed by Sellers.

  • We do not guarantee the accuracy, quality, or legality of the content provided by Sellers.

  • Sellers are solely responsible for ensuring their products comply with all applicable laws, including intellectual property laws.

SECTION 3 – IP RIGHTS AND COMPLAINT PROCEDURE

If you believe any content listed on OffOnArt infringes your intellectual property rights, please notify us by email at: legal@offonart.com with the following information:

  1. Your full legal name and contact details.

  2. A description of the copyrighted work or trademark you claim has been infringed.

  3. The URL(s) or direct link(s) to the infringing product listing(s).

  4. A statement confirming that you are the rights holder or authorized to act on their behalf.

  5. A statement made under penalty of perjury that your complaint is accurate and truthful.

Upon receiving a valid complaint, we will review the report and may remove the product from our marketplace in accordance with our marketplace policies and applicable law.

SECTION 4 – ORDERS & DELIVERY

Orders are placed directly through the marketplace. Once payment is processed, download access is provided instantly. OffOnArt is not responsible for verifying file usability on your device.

SECTION 5 – PRICES & PAYMENT

Prices are set by Sellers and may be changed without notice. All payments are processed through Shopify’s payment system, and OffOnArt may collect a commission from each sale. Taxes may apply depending on your location.

SECTION 6 – INTELLECTUAL PROPERTY & IP COMPLAINTS

  • OffOnArt does not claim ownership of any third-party products listed on the marketplace.

  • All products are uploaded by independent Sellers using AI tools.

  • Sellers are solely responsible for ensuring they have the right to sell their products.

  • If we receive a valid IP complaint, we may remove the product from the marketplace without prior notice to the Seller.

SECTION 7 – PROHIBITED USES

You may not:

  • Upload infringing, illegal, or offensive content.

  • Resell or redistribute purchased products without the Seller’s consent.

  • Use the platform to defraud, spam, or mislead others.

SECTION 8 – DISCLAIMER OF WARRANTIES

Our marketplace and all products are provided “as is” without warranties of any kind, express or implied. OffOnArt does not guarantee that products will meet your expectations, be error-free, or be fit for a particular purpose.

SECTION 9 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, OffOnArt is not liable for any damages arising from your use of the marketplace, including but not limited to loss of profits, loss of data, or claims related to third-party intellectual property.

SECTION 10 – GOVERNING LAW

These Terms are governed by the laws of the State of Wyoming, USA. Any disputes will be resolved in the courts located in Wyoming.
